Report: Cardoso’s b-sample inconclusive, but rider remains suspended

Suspended on June 18 last year due to a positive A sample for EPO, Portuguese rider André Cardoso has been on the sidelines ever since. However according to the website A Bola, the former Trek-Segafredo competitor’s B-sample was inconclusive, leading the rider and his lawyer to argue that he should have been allowed to return to competition.

They also felt that he should be reimbursed for the time that he was unable to ride.

However, A Bola reports that the UCI’s Cycling Anti Doping Foundation (CADF) has disagreed with this, with that body saying that grounds remain for the riders suspension. The case has been referred to the Legal Anti Doping Services (LADS) wing of the UCI, which is comprised of experts in this field.

A Bola notes that LADS will make a proposal called the ‘Acceptance of Consequences.’ This would see the rider given the option to accept a set punishment; if he rejects it, the case will then proceed to the UCI Anti-Doping Tribunal.

Should the latter give the rider a formal sanction, he would then be able to appeal it to the Court of Arbitration for Sport. Typically a positive test for EPO leads to a four year ban, unless the rider has a previous positive.
